MOFCOM Announcement No. 61 (2025)
MOFCOM Announcement No. 61 of 2025: decision to implement export controls on relevant rare-earth items located outside China
商务部公告2025第61号 公布对境外相关稀土物项实施出口管制的决定
English title: project / third-party translation
Summary
The extraterritorial measure of the October 2025 package. Foreign exporters must obtain a Chinese dual-use licence before shipping to third countries where the goods contain 0.1% or more by value of listed Chinese-origin rare-earth items, or were made abroad using Chinese rare-earth extraction, separation, metal-smelting, magnet-manufacturing or secondary-recovery technology, or are themselves of Chinese origin. Applications from foreign military users and from importers on the control and watch lists are refused in principle, as are WMD, terrorism and military end-uses; exports for research or production of 14nm-and-below logic chips or 256-layer-and-above memory, and for AI with potential military use, are decided case by case. Humanitarian shipments are exempt subject to post-export reporting. The controlled item lists are in an annex. Under paragraph 8, the limb covering Chinese-origin items (item 1(3)) applied from publication on 9 October 2025, while the two extraterritorial limbs (items 1(1) and 1(2)) were scheduled to apply from 1 December 2025. Before that date, Announcement No. 70 of 2025 suspended Announcement No. 61 from 7 November 2025 to 10 November 2026, so the extraterritorial limbs did not take effect on 1 December 2025.
Analytical significance
The extraterritorial 0.1% rule mirrors the design of US export controls (a de minimis / foreign-direct-product logic) and marks a qualitative escalation from controlling exports of Chinese material to controlling foreign goods derived from it. Suspended by Announcement No. 70 of 2025 through 10 November 2026. The five additional rare earths added in the same October package came from a companion instrument, Announcement No. 57, not from this one.

Framing anchors
Official framing, classified only from quoted passages.
为维护国家安全和利益EN to safeguard national security and interests
Justification clause of Announcement No. 61 (2025), verified verbatim against the MOFCOM primary. Re-anchored 2026-08-11: the claim previously cited a third-party bilingual translation and the wording coded at that time (为了维护国家安全和国家利益) does not appear in the announcement, despite a note asserting it was reproduced from the primary. Unlike Announcement No. 46, this text carries no non-proliferation clause, so only national security is coded. This re-anchoring was lost to an accidental working-tree revert on 2026-08-12 and restored the same day by re-fetching the primary and re-reading the clause.
The move was made to safeguard national security and interests and to uphold international commitments including non-proliferation, according to a statement released on MOFCOM's website on Thursday.
Chinese state-media (Global Times English edition) rendering of MOFCOM's rationale. Pairs the national-security justification with a normalization framing — that the controls are consistent with international practice and dual-use obligations.

Primary source中华人民共和国商务部 (Ministry of Commerce, PRC)
Chinese primary for Announcement No. 61 (2025), the extraterritorial rare-earth measure. Read 2026-08-12. Justification clause verbatim: 为维护国家安全和利益,根据《中华人民共和国出口管制法》《中华人民共和国两用物项出口管制条例》等法律法规相关规定,经中国国务院批准. The text contains no 防扩散 (non-proliferation) limb and no reference to international commitments, which is why the framing claim on this event codes national security only. Rebuilt 2026-08-12 after the record was lost to an accidental working-tree revert; re-verified against the primary rather than restored from a copy.
