"summary": "China's first administrative regulation governing the rare-earth industry end to end: adopted at the State Council's 31st executive meeting on 26 April 2024, signed by Premier Li Qiang on 22 June 2024, published 29 June 2024 and in force from 1 October 2024. Article 2 applies it to mining, smelting and separation, metal smelting, comprehensive utilisation, product circulation and import and export. Article 4 states that rare-earth resources belong to the State and provides for protective exploitation. Article 8 confines mining and smelting-separation to enterprises designated and published by the MIIT-led process, barring all others. Article 10 puts mining and smelting-separation under total-quantity control (总量调控) with dynamic management. Article 13 prohibits purchasing, processing, selling or exporting illegally mined or separated rare-earth products. Article 14 establishes a whole-chain product traceability information system, with flow-of-goods records required from producers and exporters. Article 15 subjects import and export to the foreign-trade and export-control regimes. Article 16 provides for a reserve system combining physical stockpiles with reserved mineral ground, and government with enterprise stockpiles.",
"analyticalSignificance": "The domestic-side counterpart to the export-control announcements: where the MOFCOM measures govern what leaves China, this governs who may produce rare earths inside it, in what quantity, and under what traceability. Two provisions bear directly on the later export measures — the Article 14 traceability system, which is the administrative apparatus a licensing regime needs to police origin claims, and the Article 16 reserve system, which is the only stockpiling authority coded on the Chinese side of this database. The instrument is also notable for what it is not: a control on exports. Its own justification clause pairs resource and ecological protection with resource and industrial security, and it makes no reference to any foreign state.",

"notes": "Article 1 of the Regulations on Rare Earth Administration, verbatim from the State Council portal; translation is this project's own. Three categories are coded because the single sentence carries three distinct limbs — resource protection and ecological security, industrial development, and national resource and industrial security. Worth contrasting with the export-control instruments: this justification is entirely domestic and mentions no foreign state, no non-proliferation obligation and no export."
